After the secession of Florida and the organization of the Confederate States Congress in 1861, the Florida Legislature elected Maxwell to the Confederate States Senate, in which capacity he served from 1862 to 1865. In 1866 Governor William Marvin appointed him to the Florida Supreme Court but Maxwell resigned within a year for political reasons. In 1877 Governor George Drew appointed him as judge of the First Judicial Circuit of Florida, an office he maintained until his resignation in 1885 to attend Florida's Constitutional Convention.
