Summary:     This microfilm publication contains the old settler Cherokee census, 1895 and the index to payment roll, 1896.  The census roll was prepared in accordance with the provisions of the Treaty of August 6, 1846, (9 Stat. 871).  This treaty provided for the payment of certain shares from funds established by the treaty of 1835 to Cherokee "Old Settlers" in Indian Territory either as original beneficiaries or as their legal heirs or representatives. A commission of 5 members appointed by the President from the party of Old Settlers working in conjunction with agents of the Union Agency completed the roll.  The Commissioners certified that the list was "correct and complete."
    Entries in the census for eligible individuals include name, age, sex, address, and various identification numbers.  No list has been found which reflects who was actually paid from the fund. However, the index to payment roll references the page number in the 1895 Census.  Entries in the census roll are arranged by agency pay number (one of the identification numbers).
    The index to payment roll is in two parts, each arranged alphabetically by either surname or Indian name.  The first part lists the names of those persons who were alive at the time of payment.  The second part lists the names of those who were deceased and whose heirs were paid. There is a schedule of unpaid shares inserted in the index volume.
