Restrictions: Restricted by Florida Statutes Chapter 394.4615:  "Unless waived by express and informed consent, by the patient or the patient's guardian or guardian advocate or, if the patient is deceased, by the patient's personal representative or the family member who stands next in line of intestate succession, the confidential status of the clinical record shall not be lost by either authorized or unauthorized disclosure to any person, organization, or agency. "  The restriction holds for any records under 50 years old, per section 257.38(2), Florida Statutes: "All public records transferred to the custody of the division shall be subject to the provisions of s. 119.07(1), except that any public record or other record provided by law to be confidential or prohibited from inspection by the public shall be made accessible only after a period of 50 years from the date of the creation of the record."

Per the Assistant General Counsel for the Department of Children and Families (email 1/19/2012), names of civil patients in files under 50 years old are confidential, but not names of forensic patients, based on language differences in the various statutes that apply.  Since the Archives is unable to distinguish between civil and forensic patients for many or most files, we will treat all as confidential.
