On January 5, 2000, Governor Jeb Bush convened the Florida Legislature in a Special Session to address capital appeals reforms. During the Special Session, legislators raised certain issues requiring further study of the sentencing of defendants in capital cases. As a result, Governor Bush issued Executive Order 2000-1 that created a 15-member Task Force on Capital Cases. The governor later superseded Executive Order 2000-1 with Executive Order 2000-26 for the Task Force to study evidence of discrimination, if any, in the sentencing of defendants in capital cases, including consideration of race, ethnicity, gender, and the possible mental retardation of the defendant. The initial meeting of the Capital Cases Task Force (CCTF) was on January 28, 2000. On March 6, 2000, Governor Bush signed Executive Order 2000-59 extending the time for the Task Force to accomplish their intended goals. The Task Force was to present their executive summary no later than April 10, 2000.
Summary:
This series documents the activities of the Capital Cases Task Force in researching the sentencing of defendants in capital cases. The series consists of articles, reports, correspondence, expert witness testimony, case law, law reviews, unofficial transcripts of meetings, handwritten notes of unidentified task force members, statistical findings regarding demographics of death row inmates and the death penalty, a videotape by Temple University Institute on Disabilities, and cassette tape recordings of the CCTF meetings.
The series also includes reports and recommendations presented before the Capital Cases Task Force. These presentations covered such topics as racism and the death penalty, racial characteristics, and prosecutorial discretion; how other states approach and handle the issues in capital cases; and the abolition of the death penalty in capital cases from 1963-1965. Presenters before the Capital Cases Task Force included law enforcement officials, members of the Association for Retarded Persons of Florida, college professors, psychologists, medical doctors, mental health professionals, the Secretary of the Department of Children and Families, representatives from the Capital Collateral Counsel, and lawyers.
