Biographical/Historical:     Sumter County was created by an act of the Legislative Council of Florida on January 8, 1853 (Chap. 548, Laws).  It was formed from the southern portion of Marion County.  Several changes were made to Sumter County's boundaries after it was created.  In 1861, when Polk county was created, Sumter County's boundary was extended south.  In 1872, an eastern portion of Sumter was annexed to Orange County.  In 1887, the eastern half was used for the creation of Lake County. The Clerk of the Circuit Court in each county serves as the official custodian of deed, marriage, and probate records.
Summary:     This series consists of a microfilm copy of the deed records for Sumter County, Florida from 1853 to 1904.  The series contains grantor and grantee indexes to deeds (1853-1928), deed record books (1853-1904), mortgagor and mortgagee indexes to mortgages filed (1853-1957), mortgage record books (1854-1886), a tax deed record book (1876-1888), foreign judgements (1855-1901), marks and brands (1879-1903) and homestead records (1879-1933, 1940, 1959, 1960).
    In the broadest sense, a deed (or conveyance) is a legal instrument by which real property is transferred from one party to another.  Deed books contain many types of title conveyances and contracts.  Among the most common types are warranty deeds, quitclaim deeds, and deeds of gift.
    A mortgage is a conditional transfer of legal title to real property as security for payment of a debt.  It is much like a deed in its form, but if the conditions prescribed within are met the conveyance becomes void.
    The homestead exemption book documents real and personal property exempt from forced sale by the courts under the homestead law of 1868.
    Many of the original record books were damaged by fire and re-recorded in the early 1900's.
