Biographical/Historical:     The Florida Legislature created the National Guard of Florida in 1909 to replace the Florida State Troops (Chapter 5930, Laws of Florida). From 1921 until 1973, the Guard was under administration of the state Military Department (Ch. 8502, Laws). In 1973, the Military Department became the Department of Military Affairs (Ch. 73-93, Laws). The Adjutant General has served as the military head of the Guard since its inception. The Department and the Adjutant General control the Florida units of the National Guard; supervise all the arms, troops, branches, and stores of the Guard; and transport and subsist any armed forces required by the state to maintain law and order. The National Guard maintains its headquarters in St. Augustine.

Summary:     This series contains by-laws created when militia companies formed under the authority of Florida laws beginning in 1887 with the codification of the militia provided for in the Constitution of 1885. These units comprised what was then the Florida State Troops and later the National Guard of Florida. The by-laws of the Island City Guards and the Santa Rosa Rifles predate this law but conform to it.

    All by-laws subscribed to the United States Army system of organization and discipline. In addition to those military regulations, the company by-laws provided local, self-imposed regulations for the operation of the company and its property. The Governor's and Adjutant Generals' approval of the by-laws created not only a military body, but a corporate body which could hold property, sue, and be sued.

    Most of the by-laws are typed or handwritten folios. However, the series does include several printed by-laws for militia companies and the Jacksonville Division of the Florida Naval Militia. The series does not include by-laws for all the units that probably functioned during this time.
