Biographical/Historical:     Madison County was created by an act of the State Legislature on December 26, 1827.  It was formed from the eastern part of Jefferson County.  In 1856, the southern half was divided to create Taylor and Layfayette counties (Chap. 806, Laws).  The Clerk of the Circuit Court in each county serves as the official custodian of deed, marriage, and probate records.
Summary:     This series consists of a microfilm copy of deed records for Madison County, Florida from 1831 to 1910, as well as a digitized copy provided by the county.  The series contains grantor and grantee indexes, deed record books, mortgage books, patent records, mortgage and lien assignments and military warrants.
    In the broadest sense, a deed (or conveyance) is a legal instrument by which real property is transferred from one party to another.  Deed books contain many types of title conveyances and contracts.  Among the most common types are warranty deeds, quitclaim deeds, and deeds of gift.      A mortgage is a conditional transfer of legal title to real property as security for payment of a debt.  It is much like a deed in its form, but if the conditions prescribed within are met the conveyance becomes void.
