Biographical/Historical:     Hamilton County was created by an act of the Legislative Council on December 26, 1827.  Hamilton County was originally a part of Jefferson County.  The Clerk of the Circuit Court in each county serves as the official custodian of deed, marriage, and probate records.
Summary:     This series consists of a microfilm copy of probate records for Hamilton County, Florida from 1830 to 1947.  The series contains a record of wills (1919-1947), probate record books (1848-1916), miscellaneous record books (1873-1924), and estate records (1830-1915).
      Probate is the transfer of property rights and of legal responsibility for payment of taxes or custody from the deceased to another party, from a person judged incompetent or insane, or from a minor to an appointed guardian.  Probate records document the administration and distribution of an individual's estate after death.
A will is a legal instrument by which a person declares how they wish their property or estate to be disposed of after their death. Wills usually contain direct statements of relationship between the deceased and his family and denote ownership of specific property and goods.
    The miscellaneous records contain petitions to sell, petitions for administration, oaths and letters of administration, proof of will, guardianship records, oaths and adjudication of estates.
