Biographical/Historical:     In accordance with the State Constitution (Article X, Section 13, 1968), the state and its agencies and subdivisions are liable for tort claims.  When a judgment in excess of an amount specified by law is rendered, these amounts must be reported to the Legislature, and may be paid only by an act of the Legislature (F.S. 768.28(5).
    Claim or relief bills are requests for appropriations to compensate claimants for personal injury or property damage based on excessive judgment claims or equitable claims filed without an underlying excess judgment.  All claim bills are first referred to a Senate Special Master on Claims who conducts a hearing in accordance with the Rules of the Senate.  The Special Master records all proceedings and prepares a final report containing his recommendations based on the findings of fact and conclusions of law.
    On receipt of the report, the President of the Senate refers each claim bill, with the Special Master's report attached to it, to the appropriate Committee.  Prior to 1980, the claim bills were reviewed by the Senate Ways and Means Committee.  Since 1980, the Senate Appropriations Committee or the Senate Committee on Finance, Taxation, and Claims have performed this function.
Summary:     The series contains recordings of the Special Master on Claims (1975-1991, 1995-1999, 2007-2008) and Select Committee on Claim Bill Process (1987) meetings. The recordings document the hearings conducted by the Special Master to hear testimony related to the claims bills for appropriations from the Legislature to compensate claimants for personal injury or property damage resulting from the negligence of the state or its agencies and subdivisions as stipulated by law.
